In the newspapers presented on Tuesday, February 4 by lawyers for Sean M. Higginswho is charged with stroke and murder of his brothers with his Jeep Grand Cherokee in August 2024, Johnny allegedly had a concentration of blood alcohol of 0.129% when he was killed, while Matthew’s concentration was 0.134%.
Both numbers are higher than the alleged level of Higgins of 0.087%, which was above the legal direction of 0.08%.
Johnny, 31, and Matthew, 29, were riding bicycles on the side of a street in Oldmans Township, New Jersey the night before their sister Katie GaudreauThe wedding when they were hit by Higgins. The brothers were pronounced dead at the scene.
Katie has since rebuilt her wedding for July 11, 2025 in Philadelphia.
Higgins were charged with two charges of aggravated first -degree murder, two charges of reckless second -degree murder, a fourth -degree charge for violating physical evidence and a second -degree charge to leave one fatal accident.

During the Higgins Court on Tuesday – attended by parents of Johnny and Matthew, boy AND Jantheir sisters, Katia AND Kristenand the fiancé of the floor, Devin Joyce – His lawyers showed their desire to dismiss the indictment, which was given by a great jury in December 2024.
The lawyers did not claim that Gaudreaus’s blood alcohol levels played a collision role, but presented a motion to get additional information about how blood alcohol levels were collected for brothers and Higgins.
“We believe that these records are essential to ensure that our client’s constitutional rights are protected and that it is not being treated unfairly based on the amount of publicity gained,” Higgins lawyers, Richard F. Klineburger III AND Matthew V. Portelasaid in a statement received by NJ.com.
In January, Higgins rejected a guilty plea agreement that would have seen him suffer 35 years in prison. In Tuesday’s appearance, Higgins’ lawyers argued that the 35-year-old bid was higher than usual due to fame and fames around the Gaudreau family.
Moreover, lawyers plan to submit a motion that will prevent some evidence not to do it in the trial, including the results of the Higgins alcohol test.
During the hearing, the Judge of the Supreme Court Michael Silvanio Set the deadlines for the defense to submit its motions and for the prosecution to file a response.
The next date of the Higgins Court is scheduled for March 26.
