Elizabeth Holmes and Ramesh “Sunny” Balwani’s complaints to overthrow their fraud sentences and reduce their sentences in prison were denied Monday by the Northern County of California, which also refused to alleviate their joint order of $ 452 million.
Holmes, the founder of Therano and Balwani, her former COO, were convicted in trials in 2022 for fraudting investors regarding the skills of the Tarano blood testing technology. Holmes was sentenced to more than 11 years in prison, and Balwani received nearly 13 years. The two began to suffer their sentences in 2023.
In their complaint, the two argued that the district court allowed misconduct from the former Therano employees who served as appropriate witnesses, but were developed by providing improper evidence of experts without the necessary legal determination. The Appeal Panel agreed that some evidence passed in the territory of experts, but concluded that the mistakes were harmless.
Holmes also opposed the involvement of a late government report that highlighted the failures in the Therano lab, arguing that it unjustly affected the jury. But the court found the report important in creating its knowledge and purpose. Holmes argued that her rights had been violated when she was forbidden to interrogate a former Laboratory director Therano regarding aspects of his employment after Terrano. Again, the Appeal Panel disagreed, saying the court did not “abuse its discretion in limiting the intention of interrogating.”
Balwani, meanwhile, claimed that his charges had been unjustly expanded during the trial (the panel rejected this argument by force). He also argued that his right to a fair trial had been violated because the government did not correct what he said was false evidence from two investors. The court rejected that argument, too, saying even if there were problems, they would not have affected the outcome of the case.
Balwani is serving his sentence on the terminal island called brightly, a federal structure with minimal security slightly outside Los Angeles; Holmes is serving her on FPC Bryan, a minimum security federal security camp that is approximately 100 miles from Houston.
